Noted Attorney Romona Farquharson-Seymour provided information on the process of the granting of bail as offenders on bail have become targets. Of the murders committed this year 40% of the victims were on bail for various offences.
Farquharson-Seymour told ZNS News, “everyone is innocent until proven guilty. So there’s a presumption when you go in that you are eligible. However, the court looks at all of the circumstances involving that defendant whether or not their demographic, whether or not they are likely to reoffend again. So they’re looking at antecedence as well as let’s say for instance, depending on the matter, if its a matter of sexual offence, they look to see whether or not the person can be housed or live separate and apart from the virtual complainant. Will they interfere with other witnesses? Are they likely to reoffend again?”
The Attorney also explained some of the factors that can contribute to the revocation of bail. Farquharson-Seymour also opined that bail should be denied to people whose lives are in danger. “Yes, I believe it should be. Because again, the court wants to assure the safety, not only of witnesses but of the defendant as well that they are able to attend court on the day that is given. And that they can then defend themselves, charges are laid and the court process can go on. The court is concerned about that ensuring that process can go ahead and be successfully completed.”
